I was shocked to read your post and tears rolled on my cheeks. But I admire your determination to achieve your goal. Oh my God! You are a different kind of guy, Please don't lose your hope. I really don't know what kind of cancer and what stage are you at but I believe miralcles do happen. We all will pray for you. We wish you the best. I really want to say so many things but I don't know how.

I received an email on 8-8 saying card production ordered and on 8-9 about the welcome kit.
My PD is April 2 2004 EB2 (US educated for the idiot who tried to divide us b/w US and non US educated)
As a token of appreciation - I have contributed $100 to IV just now.Receipt ID: 1467-8132-5592-9911. Request all of those who get GC this month to contribute some $ amount. Although I was not very active in the forums I have contributed at least $400 to this cause and I will do the same in the future. Please do not try to divide b/w EB3 EB2 US educated etc. which I am noticing lately.
WE REALLY NEED TO HELP OUR EB3 FRIENDS. PLEASE CONTRUBUTE ONCE IN AN YEAR ATLEAST. I HAVE NOTICED THE MOMENT THEY GET GC THEY FORGET THE PAST DIFFICULTIES AND MOVE ON WHICH IS FINE. BUT IF POSSIBLE CONTRIBUTE ONCE IN AN YEAR.

Just started calling.
Started with New Hampshire senators (state where I live). The person from senator Gregg's office interestingly heard to what I said and took my message and details. Said that he would pass it on to the Senator.
The person from senator Sununu's office wasn't bad either.

In my case, i do not have a valid H-1B visa stamp. I recently visited India and used Advance Parole. Questions related to this
1) do i need to surrender my PAROLE I-94 before departing USA?
2) does canada immigration officer ask me why i have applied for canada gc while my USA gc is in process?:confused:

On July 25th lawyer sent my documents 140 & 485 concurrent, PD port from previous I-140 approval (approved at Nebraska).
Reached Nebraska Service Centre on July 26th.
Will it be processed at Nebraska Service centre or Texas Service centre? According to new direct filing instructions my employer and my residence comes under Texas Service centre.

I love my country and want to go back, but it is in the hands of rapists and looters and I suspect it will remain that way...either I become a Gandhi and spend my life liberating it, or live year with my eyes & ears closed...
It is actually funny to watch you guys fight over the US vs India.
Let me ask you this:
-If you didn't choose to study medical or IT and never came to US, would you be thinking the same (problems in India and reasons not to settle in India etc) as you are thinking today?
-If US government didn't have the provision of employment based GC, would you be thinking the same as you are thinking today(problems in India and reasons not to settle in India etc) ?
The answer of the questions above is either YES or NO. I'm sure that many of us will answer these questions as NO.
And if the answer is NO and and you are still counting problems in India and trying to justify your stay in US, then I'm afraid my friends you guys are being opportunistic.
No matter how bad it is, that country made you capable of using this forum. You shouldn't backbite and find problems and issues in that country. You should rather use your energy in solving problems in India. Don't say it is not possible. Nothing is impossible.
You can send emails/letters/flowers to senators and officials here for GC, but I'm sure that there will only be handful of you; who actually tried to send their feedback complaints to Indian government and its officials.
I can go on and on, but I leave this thought with you guys and end my post here, as I know that you got the point.

I have no problem with porting, but the priority date should be starting from when they acquired required qualifications for the job.
Example, if someone with B.S and 2 years experience had applied in EB3 in 2005 and tries to port now I think it is fair to have the ported PD not in 2005, but 2008 when the person acquired B.S + 5 years experience.
This would automatically address all those folks who deserved to be in EB2 but couldnt either becuase lawyer screwed up or issues with sponsoring company.
We got the year..how about the month and day on which to port to eb2?;)

I had read on the other forums about people receiving phone-calls from USCIS with enquiries about the employer, client, wages etc. They introduce themselves as USCIS personnel and take sensitive information from people. Could they be imposters from the Anti-Immi Side. I do urge caution not to give any Info on the phone. If USCIS wanted info from the H1B holder, they would have done it through regular mail.

On aug 9 th, USCIS nebraska center issued a total of 4063 receipt nos for 485, EAD, and APs.

From this, if we assume ~4000/day, it ll take 20 working days to clear july 2nd filers (~80,000). My guess is by 31st Aug.

EEO does not protect immigration status based discrimination. However Immigration Reform and Control Act of 1986 does protect against discrimination based on immigration status.

IRC Act 1985 deals with unlawful employment of aliens, unfair immigration-related employment practices, and fraud & misuse of certain immigration-related documents.
Two different things.
However, once H-1B applicant is hired, he/she is protected just like any other worker, for job promotions, training, and other work conditions. But employer is under no obligation to extend H-1B beyond any initial H-1B petition date. And, yes, H-1B can also be fired at will*, just like any other worker.

Funny .... Lawyers, Senators, USCIS Employees accept that, current immigration is broken. The current immigration does not make sense. But we want make some meaning out of it.
